By accessing or using Stonks Radio (the “Service”), operated by Sameer Kumar Dash (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you must not use the Service.

2. Description of Service

Stonks Radio is an audio-first, AI-powered platform that provides spoken market commentary and informational updates about stocks listed on the National Stock Exchange (NSE) of India. The Service is accessible via web browser and does not require a separate app download.

3. Not Investment Advice

4. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

5. Account & Authentication

• You may be required to authenticate via WhatsApp OTP or other methods to access certain features.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• You agree to provide accurate information during the registration process.
• We reserve the right to suspend or terminate your account if we suspect unauthorised or fraudulent use.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable Indian law
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Scrape, crawl, or use automated tools to extract data from the Service
• Redistribute, resell, or commercially exploit the audio content or data provided by the Service
• Interfere with or disrupt the Service or its underlying infrastructure
• Impersonate another person or misrepresent your affiliation with any entity

7. Intellectual Property

All content, audio, text, graphics, logos, software, and other materials available on the Service are the property of Sameer Kumar Dash or its licensors and are protected by Indian and international intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any content without our prior written consent.

8. Third-Party Services

The Service may integrate with or link to third-party services (e.g., market data providers, Firebase, WhatsApp). We are not responsible for the content, privacy practices, or availability of these third-party services. Your use of third-party services is governed by their respective terms and policies.

9. Availability & Modifications

• We strive to keep the Service available during NSE market hours (9:15 AM – 3:30 PM IST), but do not guarantee uninterrupted access.
• We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.
• The Service is currently in beta. Features, pricing, and availability may change.

10. Limitation of Liability

To the fullest extent permitted by applicable Indian law, Sameer Kumar Dash and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

In particular, we shall not be liable for any financial losses incurred as a result of investment decisions made based on information provided by the Service. All investment decisions are made at your own risk.

11. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not warrant that the Service will be error-free, uninterrupted, or that any information provided will be accurate, complete, or current.

12. Indemnification

You agree to indemnify and hold harmless Sameer Kumar Dash, its directors, employees, and affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in India. The parties agree to first attempt to resolve any dispute through good-faith negotiation before pursuing formal legal proceedings.

We may revise these Terms at any time by updating this page. Material changes will be communicated via the Service or through other reasonable means. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
